This eCommerce Policy explains how CLIENTs can use Convene for the Cities' systems for selling products, offering services, or collecting payments online. It also outlines CLIENT responsibilities and what is not allowed. By using Convene for the Cities' systems, CLIENTs agree to follow this Policy.
1. CLIENT eCommerce Responsibilities:
Convene for the Cities provides tools to help CLIENTs sell goods, services, or accept payments. Convene for the Cities is not responsible for these transactions. CLIENT takes full responsibility for the following:
- Taxes: CLIENT must calculate, collect, and pay all taxes related to their eCommerce. They are also responsible for providing proper invoices. Any tax features in Convene for the Cities are just examples and not legal advice.
- Fulfillment: CLIENT must deliver their own products or services to customers. They may utilize 3rd party fulfillment services if desired.
- Claims and Warranties: CLIENT handles any guarantees or claims made.
- Customer Service: CLIENT must manage all inquiries and complaints, including issues like refunds and chargebacks. CLIENT contact details must be listed on their site.
- Legal Terms: CLIENT must publish a privacy policy and follow all applicable laws. Convene for the Cities does not provide legal advice. Client may purchase a subscription for these policies from Convene for the Cities but it is Client’s responsibility to have their legal counsel approve of the policy(ies) for their use.
- Restricted Items: CLIENT cannot sell anything illegal, dangerous, or against the law, including anything counterfeit or offensive.
- Suspension: Convene for the Cities can suspend or remove CLIENT accounts or eCommerce access if this policy is violated. Convene for the Cities is not liable for losses.
- Payment Processors: CLIENT may only use approved processors. These are managed separately from Convene for the Cities. Convene for the Cities may disable unapproved processors at any time.
- Payment Restrictions: Only MND Merchant Accounts have been approved for use in Convene for the Cities. Services like PayPal, Stripe, and Amazon Pay are not approved.
- Payment Setup: CLIENT must complete MND Merchant Account partner underwriting within 10 business days. If delayed, support may be billed at standard rates.
- Taxes on Services: CLIENT must pay taxes on Convene for the Cities' services unless they provide a valid exemption certificate.
- Risk Limitation: CLIENT may not use Convene for the Cities; services where failure could cause harm or damage.
